If you were hurt at work in California, workers' compensation should pay for your medical treatment, temporary disability checks while you cannot work, and permanent disability if you do not fully recover. Insurance companies often delay treatment, deny claims or offer low settlements.
Daniel Weltin represents injured workers across the Bay Area and Northern California: warehouse, construction, restaurant, cleaning, farm, trucking and port workers. Many of our clients speak Spanish, and you can talk to us in Spanish from the first call.
No. In California, injured workers can receive workers' compensation benefits regardless of immigration status. Read more in our guide: California workers' comp rights regardless of immigration status.
When someone other than your employer caused your work injury, you may also have an injury lawsuit for full damages. In one case, a worker who was found 100% permanently disabled after a fall also recovered the $900,000 policy limits in a separate civil claim. Past results do not guarantee a similar outcome.
Tell your employer about the injury right away, in writing if you can, and ask for a claim form (DWC-1). In California you generally must report a work injury within 30 days.
From our office in San Leandro, we represent injured workers throughout the Bay Area and Northern California, including Alameda, Contra Costa, San Francisco, San Mateo, Santa Clara, Solano, Marin, Sonoma, Napa, Sacramento and San Joaquin counties. That includes cities such as Oakland, Hayward, San Leandro, Fremont, Richmond, Concord, San Jose, Vallejo, Santa Rosa, Sacramento and Stockton.
Your case is usually heard at the Workers' Compensation Appeals Board office for the area where you live or where you were hurt. Alameda and Contra Costa County cases usually go to the Oakland office at 1515 Clay Street. San Francisco and San Mateo cases go to San Francisco, Santa Clara cases go to San Jose, and San Joaquin cases now go to Lodi, after the Stockton office moved there in 2023. You can talk with us by phone or video, and we meet in person when needed.
